Terms of Service

By accessing or using FriendSchedule ("the Service"), operated by Jetfuel AI ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Description of Service

FriendSchedule is a web-based scheduling poll tool that allows users to create polls, share them with others, and collect availability responses. The Service is provided as a convenience tool and is not intended for mission-critical scheduling.

2. No Guarantee of Availability

The Service is provided on an "as available" basis. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice, for any reason. We are under no obligation to maintain, support, or update the Service. The Service may be shut down permanently at any time without prior warning.

You acknowledge that you have no expectation of continued access to the Service or to any data stored within it. You are responsible for maintaining your own copies of any information that is important to you.

3. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited emails, or bulk invitations to people who have not consented
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools (bots, scrapers) to interact with the Service
• Violate any applicable local, state, national, or international law
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to any part of the Service

We reserve the right to terminate or restrict your access to the Service at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to us, other users, or third parties.

4. User Content

You retain ownership of content you submit (poll titles, descriptions, names, votes). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely as necessary to operate the Service.

We do not monitor user content proactively but may remove content that violates these Terms or applicable law.

5. Email Communications

The Service sends transactional emails (poll invitations, reminders, admin links) on your behalf. By providing email addresses of invitees, you represent that you have a reasonable basis to contact those individuals and that the emails are not unsolicited spam.

We are not responsible for the content of messages you cause to be sent through the Service. You are solely responsible for compliance with applicable anti-spam laws (including CAN-SPAM).

6. Intellectual Property

The Service, including its design, code, and branding, is the property of Jetfuel AI and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data will be preserved. We make no guarantees regarding uptime, reliability, or data integrity.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JETFUEL AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED $0 (ZERO DOLLARS) AS THE SERVICE IS PROVIDED FREE OF CHARGE.

9. Indemnification

You agree to indemnify and hold harmless Jetfuel AI from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or your violation of these Terms.

10. Data Deletion

You may delete your poll at any time using the admin link. When you delete a poll, all associated data (options, participants, votes) is permanently removed. If the Service is discontinued, all data will be deleted.

11. Third-Party Services

The Service uses third-party providers for email delivery (Resend), bot verification (Cloudflare Turnstile), and hosting infrastructure. Your use of the Service is also subject to the terms and policies of these providers.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Sacramento County, California.

13. Changes to Terms

We may update these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
